Establishment and jurisdiction
Special prosecutor office for cyber crime has been founded by the Law on organization and Jurisdiction of government authorities in suppression of high technological crime, published in Official gazette of the Republic of Serbia 61/2005.
On 20th of February 2007 State prosecutor has nominated Lidija Komlen Nikolic as special prosecutor for cyber crime.
Special prosecutor office for cyber crime is established within the District prosecutor office in Belgrade and have jurisdiction of the territory of the Republic of Serbia to proceed in criminal offences specified in Article 3 of the Law.
Head office is temporary situated in Belgrade, Palace of justice, street Savska 17a.
Organization
The Special Prosecutor is appointed by the Republic Public Prosecutor from among Public Prosecutors and Deputy Public Prosecutors meeting the requirements for appointment as Deputy Public Prosecutor, under written consent of the appointee. The knowledge of information technologies is the advantage of the Special Prosecutor.
The Special Prosecutor is appointed to a term of office of four years and may be re- appointed.
The Republic Public Prosecutor shall, prior to appointment of Special Prosecutor, first issue a decision on seconding such person to the Special Prosecutor's Office.
Objectives
Special prosecutor office for cyber crime has been founded for the purpose of efficient detection and prosecution of perpetrators of criminal offences stipulated in this Law.
High tech crime
This Law shall be applied in detecting, prosecuting and processing perpetrators of the following criminal offences:
criminal offences against security of computer data defined by Criminal Code of the Republic of Serbia
criminal offences against intellectual property and legal traffic which are committed by using , as object or tool of committing the offence, computers, computer networks, computer data, including their products in tangible or electronic form, and the number of items of copyrighted works is over 500, or the amount of the actual damage is over 850.000,00 dinars.
